Terms of Service

1. Acceptance of Terms

By downloading or using Eclat Camera ("Eclat"), you agree to these Terms of Service. If you do not agree, do not use the app.

2. Service Provider

Eclat is published by Orichalque SAS, 26 rue Bosquet, 75007 Paris, France. Contact: eclat@orichalque.net.

3. License and Scope of Use

Subject to these Terms and Apple's applicable terms, you receive a limited, non-exclusive, non-transferable, revocable license to use Eclat on Apple-branded devices you own or control.

You may not:

  • reverse engineer, decompile, or disassemble the app except where permitted by law,
  • use the app for unlawful purposes,
  • redistribute, resell, or sublicense the app without authorization.

4. User Responsibilities

You are responsible for your use of the app, your device security, and your compliance with local laws, including laws related to photography, privacy, and intellectual property.

5. Intellectual Property

Eclat, including software, design, branding, and related materials, is protected by intellectual property laws. All rights not expressly granted are reserved by Orichalque SAS.

6. Optional Donations and Payments

Eclat offers optional one-time donations as in-app purchases. Donations are voluntary and non-recurring unless otherwise explicitly stated by Apple purchase screens. Payment processing is handled by Apple.

7. Disclaimers

Eclat is provided on an "as is" and "as available" basis to the maximum extent permitted by law. We do not guarantee uninterrupted operation, complete error-free behavior, or compatibility with all devices and OS versions.

8. Limitation of Liability

To the maximum extent permitted by law, Orichalque SAS is not liable for indirect, incidental, special, consequential, or punitive damages arising from use of Eclat. Nothing in these Terms excludes liability that cannot be excluded under applicable law.

9. Apple Platform Clause

These Terms are between you and Orichalque SAS, not with Apple. Apple is not responsible for the app, support, maintenance, or claims related to the app, except as required by law. Your use of Eclat must comply with Apple's applicable terms for App Store applications.

10. Governing Law and Venue

These Terms are governed by the laws of France, without regard to conflict-of-law principles. Competent courts of Paris, France shall have jurisdiction, subject to mandatory consumer protection rights in your country of residence.

11. Changes to Terms

We may update these Terms from time to time. Continued use of Eclat after changes become effective constitutes acceptance of the revised Terms.
